1. The petitioner, in this Writ Petition, has prayed for the following reliefs:-
“(i) That, this Hon'ble Court may kindly be pleased to quash impugned order dated 23.01.2023 (Annexure P-1) passed by the learned Commissioner Bilaspur Division Bilaspur, District Bilaspur (C.G.) in revision case No. 19/A-74/2022- PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2026.09.26 10:41:25 +0530
2 23 which is arising out of order dated 22.11.2021 (Annexure P-2) passed by the learned Additional Collector Korba, District Korba Chhattisgarh, in the interest of justice. (ii) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to pay compensation amount of Rs.4,00,000/- as per circular dated 01.12.2022 within stipulated time, in the interest of justice. (iii) Any other relief which may be suitable in the
facts and circumstances of the case, may also be granted, in the interest of justice.”
2. Facts of the case in brief are that the petitioner’s husband- Deepak Kumar Yadav, died due to drowning in Bhelwadabhra Reservoir on
27.02.2021. The petitioner claimed compensation on account of his death under the State Government Circular dated 01.12.2022. The Sub- Divisional Officer (Revenue), Katghora, recommended compensation of Rs.4,00,000/- vide order dated 27.09.2021. However, the Additional Collector, Korba, rejected the petitioner’s claim vide order dated
22.11.2021. The revision preferred by the petitioner under Section 50 of the C.G. Land Revenue Code was also dismissed by the Commissioner, Bilaspur Division, Bilaspur, vide order dated 23.01.2023. Hence, this petition.
3. Learned counsel for the petitioner submits that the deceased died due to drowning, as is evident from the diatom report and that the petitioner is entitled to compensation of Rs.4,00,000/- in terms of the Revenue Board circular dated 01.12.2022. He further submits that despite the
3 recommendations made by the concerned revenue authorities, the claim of the petitioner has been rejected by wrongly treating the death as suicide. He, therefore, submits that the impugned order is liable to be set aside and the petitioner is entitled to the aforesaid compensation.
4. Learned State counsel has no objection to the prayer made by learned counsel for the petitioner.

Having considered the submissions made by learned counsel for the parties and particularly considering the fact that as per the diatom report, it was found that the death occurred due to drowning, which is conclusive in this respect, the respondent authorities are directed to grant compensation to the petitioner in terms of Revenue Board circular, in accordance with law within a period of 45 days from the date of receipt of a copy of this order.
6. With the aforesaid observations and directions, the present petition stands disposed of.
