1. The appellant is one of several accused persons. The accused persons were charged under various provisions of Indian Penal Code, Arms Act and Explosive Substances Act. 2. Learned Advocate for the appellant says that various accused persons have been granted bail including Amitava Bhanja @ Babu Bhanja and Sujit Kar, who were granted bail by a Coordinate Bench of this Court by an order dated June 24, 2026. The present petitioner stands on the same footing as those two persons. Hence, on the ground of parity, the privilege of bail should also be extended to the present petitioner. 3. Learned Senior Counsel for NIA, in his usual fairness, says that insofar as the role of this petitioner in the alleged
2 offence is concerned, the same is more or less similar to the role of Amitava Bhanja @ Babu Bhanja and Sujit Kar. It is just that Amitava Bhanja @ Babu Bhanja and Sujit Kar were in custody for a few days more than the present petitioner. 4. In view of the fact that the petitioner and the said Amitava Bhanja @ Babu Bhanja and Sujit Kar are similarly circumstanced insofar as their respective roles in the alleged crime are concerned, on the ground of parity, we allow this application. 5. Accordingly, the accused person namely, Soumitra Mondal shall be released on bail upon furnishing a bond of Rs.50,000/-, with two sureties of Rs. 25,000/-each, one of whom must be local, subject to the satisfaction of Learned Chief Judge, City Sessions Court, Calcutta and also on following conditions: - (a) That he shall reside within the jurisdiction of New Town Police Station, Kolkata and shall provide the particulars of the intending visitors to the Investigating Officer beforehand.
(b) That he shall not leave the above jurisdiction without permission of the learned Chief Judge, City Sessions Court, Calcutta and shall appear on each and every date of hearing before the learned Court. 3 (c) He shall use only one mobile phone number and the same shall be intimated to the concerned Investigating Officer. (d) He shall meet the I.C., New Town Police Station twice in week on different dates as would be fixed by the said Police Officer. (e) The concerned Investigating Officer shall keep a vigil on the appellant and can monitor his phone calls. (f) The appellant shall not intimidate and influence vulnerable witnesses either by himself or through his agents, personnel etc., and shall cooperate with the Investigating Officer in conducting further investigation, if any. (g) In default of any of the conditions, bail granted to the appellant shall stand cancelled without any further reference to this Court. 6. CRA (DB) 273 of 2026 stands disposed of. 7.
