Affidavit of service filed be taken on record. 2. The writ application has been preferred challenging the orders dated 17.03.2026 passed under Section 14B of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 in Diary No.180/2025 and the consequential Demand Notice dated 17.03.2026 issued under Section 7Q of the said Act. 3. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the petitioner herein has filed an appeal before the appropriate forum being the learned Central Government Industrial Tribunal- cum-Labour Court, Kolkata on 14.05.2026. The said appeal has been numbered as 28/EPF/2026. 4. Admittedly, at present there is no regular Presiding Officer at the CGIT, Kolkata. 5. It appears that the appeal filed is thus pending before the CGIT, Kolkata for adjudication and the 2 petitioner has been unable to obtain any interim relief from the Tribunal due to the vacancy there. 6. Considering the said facts, the writ application is disposed of with the direction that the impugned orders dated 17.03.2026 passed under Section 14B of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 in Diary No.180/2025 and the consequential Demand Notice dated 17.03.2026 issued under Section 7Q of the said Act be stayed and the respondent authorities shall also not take any coercive action against the petitioner till the matter is taken up by the learned Tribunal. The learned Tribunal shall be at liberty to decide the prayer of the petitioner for further relief, in accordance with law. 7. WPA 21419 of 2026 stands disposed of. 8. There shall be no order as to costs. 9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on an usual undertaking. (Shampa Dutt (Paul), J.)
