Accused No.1 in Crime No.93/2026 registered by Hebbagodi Police Station, Bengaluru, for the offences punishable under Sections 85, 109 and 3(5) of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.93/2026 was registered by Hebbagodi Police Station, Bengaluru, for the aforesaid offences against the petitioner and others, based on the first information dated 14.02.2026 received from Smt. Soundarya, who is the wife of the petitioner. Apprehending arrest in the case, he had filed Crl.Misc.No.5335/2026 before the jurisdictional Sessions Court, which was rejected on 16.07.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that marriage of the petitioner with the first informant was - 3 - HC-KAR CNR: KAHC010513842026 NC: 2026:KHC:46790 CRL.P No. 11389 of 2026 solemnized on 17.08.2025. It is alleged in the first information that after marriage she was being ill treated in her matrimonial house in furtherance of demand for dowry. It is further alleged that on 08.09.2025, petitioner after quarreling with his wife had assaulted her and she had suffered injuries. The offence punishable under Section 109 of IPC has been invoked in present case. In respect of the alleged incident that had taken place on 08.09.2025, first informant has approached the police belatedly on 14.02.2026, which is after a lapse of five months from the alleged date of incident. Learned HCGP has brought to the notice of this Court that the victim had suffered only simple injures as a result of the assault made by petitioner on 08.09.2025. Considering the aforesaid aspects of the matter, I am of the opinion that his prayer for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.93/2026 registered by Hebbagodi Police Station, Bengaluru, for the - 4 - HC-KAR CNR: KAHC010513842026 NC: 2026:KHC:46790 CRL.P No. 11389 of 2026 offences punishable under Sections 85, 109 and 3(5) of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
