Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case for the death of his wife. It has been submitted that the incident took place after 26 years of marriage and the petitioner is in custody for 2½ years. In the meantime, only 8 witnesses have been examined out of the cited 17 witnesses. There were earlier directions from this Court to conclude the trial within schedule period of time. Learned advocate for the State has produced the case diary. I have taken into account the nature of the injury and the petitioner being the sole accused in the present case it has been complained that there was deferment of cross-examination 2 repeatedly for which the trial has stretched for a considerable period of time. Having considered the medical report and the factum of the manner of death of the deceased, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM(M)266 of 2026 is rejected. As earlier directed, trial court would take steps for expediting the progress of the trial. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
