As prayed for, leave is granted to the petitioner to add the District Magistrate 24-Parganas (South) as party to the present writ petition. 2. The petitioner alleges inaction on the part of the respondent CESC authorities in shifting of the meter of the petitioner to a portion under the occupation of the petitioner from the place where the meter has been presently installed to a place within the control of the petitioner. 3. The CESC authorities filed a report on August 12, 2026, which reveals that shifting of the meter of the petitioner from its present place to a place under the occupation of the petitioner would not be technically feasible inasmuch as, the passages through which electric line may be taken are not demarcated, the same are underdeveloped and they traverse a wetland. 4. The report further indicates that the passages,
which could be used for laying down cable upon shifting the meter are blocked by fencing and a big open drain passes beside the land of the petitioner, thereby making laying underground or overhead line along the passage technically infeasible. 5. In cases where, electricity connection cannot be provided or electrical installations cannot be shifted in view of disputes, pertaining to property, between private parties the recourse for resolution of such disputes is provided under Rule 3 of the Works of Licensees Rules, 2006. The District Magistrate of the relevant district is one of the authorities prescribed under Rule 3 of the 2006 Rules. 6. Accordingly, the petitioner is granted liberty to approach the District Magistrate, 24-Parganas (South) by filing an appropriate representation detailing therein her grievances. 7. Once the representation is filed, the District Magistrate shall consider the same, initiate appropriate proceedings, conduct inspection and dispose of the same by passing a reasoned order, in accordance with law, upon hearing all the parties. 8. It is needless to mention that all inspections would be conducted in presence of all parties including the petitioner, the private respondents and the CESC authorities and copies of inspection report shall be provided to all parties to enable them to take 2
exception thereto. 9.
The District Magistrate shall pass appropriate order aiming solution to the present problem. The aforesaid exercise shall be concluded within a period of eight weeks from the date of making of the representation. The District Magistrate shall communicate the reasoned order to all parties within a week from the date of passing thereof. 10. With the above observations, WPA 17409 of 2026 stands disposed of. There shall be no order as to costs. 11. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.) 3
