In this petition, the petitioner is challenging the Endorsement bearing No.RRT/CR/309/2024-25 dated 07th April, - 3 - HC-KAR CNR: KAHC010532362026 NC: 2026:KHC:44548 WP NO.24372 OF 2026 2025 (Annexure-G) issued by the respondent No.3 and Endorsement dated 14th January, 2026 (Annexure-J) issued by the respondent No.2. 3. Heard Sri. G.M. Srinivasareddy, learned counsel appearing for petitioners and Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents. 4. Having heard the learned counsel appearing for the parties, on perusal of the averments made in the writ petition, it is forthcoming that the petitioners have preferred appeal before the respondent No.2 under Section 136(2) of the Karnataka Land Revenue Act (for short, hereinafter referred to as 'KLR Act'). However, the respondent No.2-Assistant Commissioner without registering the appeal by giving a case number, had rejected the appeal on 14th January, 2026 (Annexure-J). The said action on the part of the respondent No.2 is deprecated. In view of the fact that the petitioners have preferred appeal under Section 136(2) of the KLR Act, it is the duty of the competent Appellate Authority to follow the provisions under the KLR Act and the Rules made there under - 4 - HC-KAR CNR: KAHC010532362026 NC: 2026:KHC:44548 WP NO.24372 OF 2026 and thereafter, take decision in the matter in accordance with law. Hence, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Endorsement dated 14th January, 2026 (Annexure-J) issued by the respondent No.2 is hereby set-aside; and matter is remitted back to the respondent No.2 to register the appeal and take decision in the matter in terms of the observation made above; (iii) Since the parties are represented by their respective learned counsels, parties are directed to appear before the respondent No.2-Assistant Commissioner on 21st September, 2026 at 03.00 p.m. SD/- (E.S.
