... Non-Applicant(s) For Applicant : Ms. Divya Sahu, Advocate. For Non-Applicant/State : Ms. Laxmin Kashyap, Panel Lawyer Hon'ble Mr. Rakesh Mohan Pandey, Judge Order on Board 25/09/2026
1. The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 191/2023, registered at Police Station Gourela, District Gourela- Pendra-Marwahi (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act,
1985. 2. As per the prosecution case in brief, on 05.06.2023, on the basis of information received from an informant, the police intercepted a KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 Duster car bearing registration No. CG-04-HN-7138, which was under the possession and control of the applicant, near Excise Check Post, Village Kevchi. Upon search of the vehicle, two plastic sacks containing 25 kg and 20 kg of cannabis (ganja), totalling 45 kg, were allegedly recovered. The vehicle and a mobile phone were also seized and accordingly, Crime No. 191/2023 was registered against the applicant and co-accused under Section 20(b) of the NDPS Act. 3. Learned counsel for the applicant would submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the applicant is in custody since 05.06.2023 and has no criminal antecedents. It is also submitted that the entire investigation has been completed, charge-sheet has already been filed and the alleged contraband, vehicle and other articles have already been seized. Lastly, it is submitted that out of 16 prosecution witnesses, not even a single witness has been examined so far and the conclusion of the trial is likely to take some time. Therefore, learned counsel prays for grant of bail to the applicant. 4.
On the other hand, learned State counsel opposes the prayer for grant of bail and submits that 45 kg of cannabis was recovered from the vehicle which was under the possession and control of the applicant, which is much above the commercial quantity prescribed under the NDPS Act. Therefore, looking to the nature and gravity of the offence and the quantity of contraband recovered from the
3 vehicle of the applicant, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary and other material available on record. 6. Considering the facts and circumstances of the case, nature and gravity of the offence alleged against the applicant and particularly, the fact that 45 kg of cannabis was allegedly recovered from the vehicle which was under the possession and control of the applicant, which is much above the commercial quantity and the applicant has failed to explain the same and further considering the provisions contained in Section 37 of the NDPS Act, this Court is of the considered view that it is not a fit case to enlarge the applicant on bail. 7. Accordingly, the bail application of the applicant namely- Piyush @ Shubhank Singh, involved in Crime No. 191/2023, registered at Police Station Gourela, District Gourela-Pendra-Marwahi (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, is rejected. 8. However, this Court hopes and trusts that the trial Court would make an earnest endeavour to conclude the trial expeditiously from the receipt of this order in accordance with law, if there is no legal impediment.that the trial Court would make an earnest endeavour to conclude the trial expeditiously fro legal im Sd/-
