1. By way of the present petition, the petitioner seeks a direction to respondent Nos.4 and 6 to permit him to join at his transferred place of posting, i.e. on the post of Secretary, Gram Panchayat Saraipali, by relieving him from Gram Panchayat Kotasura, pursuant to the transfer
order dated 02.04.2025.
2. Learned counsel for the petitioner submits that, pursuant to the communication dated 22.12.2025 (Annexure P/7), the petitioner was
directed to hand over the charge to one Rupendra Sahu. However, the said person was not available on the date when the petitioner intended to hand over the charge. He further submits that the petitioner, in response thereto, submitted a communication dated 24.12.2025 to the Chief Executive Officer, Zila Panchayat, Raigarh, which is filed as Annexure P/8.

Learned counsel for respondent No.4 to 6, by referring to the reply filed on behalf of respondent No. 4 & 5, particularly paragraph 7 thereof, submits that the petitioner has not handed over the charge to the incumbent who has already been posted at Gram Panchayat Kotasura. He refers to the communications dated 25.04.2025 and 04.11.2025 and submits that, as on date, the post of Secretary, Gram Panchayat Kotasura, is occupied by the incumbent presently posted there. He submits that the
3 petitioner may hand over the charge to the present incumbent and, thereafter, he would be relieved from the said Gram Panchayat.
4. Learned counsel for the petitioner submits that, in view of the aforesaid submission made on behalf of respondent No.4 to 6, the petitioner is ready and willing to hand over the charge to the present incumbent.
5. I have heard learned counsel for the parties and perused the material available on record.

In view of the aforesaid submission made by the parties and the stand taken in the reply, the present petition is disposed of with a direction to the petitioner to hand over the charge of the post of Secretary, Gram Panchayat Kotasura, to the present incumbent posted there. Upon handing over the charge to the present incumbent, respondent No.4 shall relieve the petitioner forthwith so as to enable him to join at his transferred place of posting in terms of the transfer order dated
02.04.2025. Respondent No.4, Chief Executive Officer, Zila Panchayat, shall ensure due compliance of this order and shall take all necessary steps for handing over and taking over the charge.
7. The petitioner shall approach the present incumbent posted at Gram Panchayat Kotasura as well as respondent No.4 on 29.12.2025 for the purpose of handing over the charge.
8. The writ petition is accordingly disposed of.
