Charge sheet is filed for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act'). It is submitted that earlier on four occasions before this Court, the bail petitions have been rejected. This is the fifth petition. 2. It is submitted that there is an assault on the petitioner in the jail by jail mates. Learned counsel for the petitioner would submit that, there is a changed circumstance and taking note of the same, the bail has to be granted. 3. The Court is of the view that the said ground cannot be a ground to grant bail. In case there is an assault, the jail authorities have to ensure such incident - 3 - HC-KAR NC: 2026:KHC:21240 CRL.P No. 17661 of 2025 does not take place and appropriate action is to be initiated against the offender as advised in law.
