17. 17. 31.08.2026 (D/L) (D/L) CT. NO. 05 CT. NO. 05 (ARPAN-A.R.CT.) In The High Court at Calcutta CONSTITUTIONAL WRIT Jurisdiction (Appellate Side) W.P.A. 21032 OF 2026 SEKH MANNAN ALI AND ANOTHER VS. STATE OF WEST BENGAL AND OTHERS …………… Ms. Gopa Biswas, Adv. Mr. Mainak Ghosal, Adv. Mr. Naman Shah, Adv. Ms. Brinta Dutta, Adv. …For Petitioners Mr. Abhijit Roy, Sr. Adv. Mr. Gopal Krishna Sarkar, Adv. …For State Mr. Indranil Chandra, Adv. Mr. Souvik Sarkar, Adv. …For Respondent No.6
1. Affidavit-of-service filed on behalf of petitioners is taken on record. 2. By presenting this writ petition prayer is made for directing concerned police authority to take steps in consideration of the order passed by Civil Court on 1st August, 2025 in Title Suit no.472 of 2025. 3. It is submitted on behalf of petitioners that vide ex- parte ad interim order of injunction dated 1st August, 2025 parties to the suit were directed to maintain status quo over the suit property. Petitioners are plaintiffs in aforesaid title suit which is pending before learned Civil Judge (Junior Division), 1st Court, Uluberia. Steps are being taken by defendants in the aforesaid suit which violates order passed by the Civil Court as it is alleged during course of hearing on behalf of petitioners. 4. State respondents and respondent no.6 are represented by learned advocates. [2]
5. Learned advocate representing respondent no.6 submits that respondent no.6 is not party to the aforesaid title suit and no steps have been taken by respondent no.6 which would violate said ex-parte ad interim order of injunction dated 1st August, 2025. 6. On perusal of ex-parte ad interim order of injunction dated 1st August, 2025, it appears that parties to the suit were directed to maintain status quo over the suit property. If petitioners find that said order of the Civil Court is violated, in that event, there is an alternative remedy available to petitioners to approach Civil Court. At this stage by entertaining this writ petition, Court does not find it apt to direct the concerned police authorities which would preserve right of petitioners over the suit property. 7. In view of availability of alternative remedy present writ petition is not entertained and same stands dismissed. 8. However, this order shall not preclude petitioner to take steps, in accordance with law, if so advised. 9.
