Mr. Gupta, learned Advocate appearing for the petitioner, submits that the petitioner has been implicated in this case solely on the basis of the confessional statement made by a co-accused person. He submits that the prosecution has failed to bring any other material to connect the present petitioner with the alleged offence. He submits that, taking note of these facts, the privilege under Section 482 of the BNSS can be extended in favour of the petitioner. 2. Mr. Acharyya, learned Advocate appearing for the State, produces the case diary and memorandum of evidence and opposes the prayer for anticipatory bail. 3. In response to my query, he, in his usual fairness, submits that, apart from the confessional statement of the co-accused person, no other material against the present accused person has been collected by the prosecution till date. 4. Heard the learned Advocates appearing for the respective parties and perused the case diary and other materials. Undisputedly,
2 the petitioner has been implicated in this case on the basis of the confessional statement of a co-accused person. The case was started on
24.06.2026. There is no evidence showing that the petitioner had any criminal antecedent, that the petitioner had any telephonic conversation with the principal accused person at the relevant point of time, or that the petitioner was involved in any money trail. Taking note of these facts, I am of the view that the benefit under Section 482 of the BNSS can be extended in favour of the petitioner. 5. In view of the above, the prayer for anticipatory bail is allowed. 6. Accordingly, I direct that, in the event of arrest, the petitioner, viz. Neksar Mondal @ Nekchar Mondal be released on bail upon furnishing a bond of Rs.
20,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court, under NDPS Act, Berhampore, Murshidabad and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition petitioner shall meet the investigating officer once in a week until submission of charge-sheet. 7.
