JUSTICE M.NAGAPRASANNA ORAL ORDER In W.P.No.9269/2026, the petitioner is before the Court seeking the following prayers: "a) Issue a writ of certiorari or any other appropriate writ, order or direction quashing the summons bearing No.PMLA/SUMMON/BGZO/2026/4424 vide ANNEXURE-A issued by the Respondent under Section 50 of the Prevention of Money Laundering Act; b) Declare that the initiation of proceedings against the petitioner under Section 50 of the PMLA without disclosing the ECIR details or material particulars is arbitrary and illegal; c) Grant such other reliefs as this Hon'ble Court deems fit in the interests of justice and equity." 2. In W.P.No.9090/2026, the petitioner is before the Court seeking the following prayers: "a) Issue a writ of certiorari or any other appropriate writ, order or direction quashing the summons (ANNEXURE-A) bearing No.PMLA/SUMMON/BGZO/2026/4423 issued by the - 4 - HC-KAR NC: 2026:KHC:21316 WP No. 9269 of 2026 C/W WP No. 9090 of 2026 second respondent under Section 50 of the Prevention of Money Laundering Act; b) Declare that the initiation of proceedings against the petitioner under Section 50 of the PMLA without disclosing the ECIR details or material particulars is arbitrary and illegal; c) Grant such other reliefs as this Hon'ble Court deems fit in the interests of justice and equity." 3. Heard Sri.Ranganath Reddy R, learned counsel appearing for the petitioners, Smt.Anuparna Bordoloi, learned counsel appearing for the respondent and have perused the material on record. 4. In W.P.No.9090/2026, this Court in terms of an order dated 24.03.2026 had directed the respondent not to precipitate the matter. 5. The learned counsel Smt.Anuparna Bordoloi, appearing for the respondent, moved the matter on the score that the summons is no longer in subsistence as the complaint is filed before the concerned Court. Learned counsel Sri. Ranganath Reddy appearing for the petitioner placing reliance on the judgment of the Hon'ble Apex Court in the case of TARSEM LAL vs. DIRECTORATE OF ENFORCEMENT JALANDHAR ZONAL OFFICE, reported in 2024 INSC 434 would submit that till cognizance is taken, the apprehension of arrest looms large. 7. Learned counsel for the Enforcement Directorate submits that they cannot arrest. 8. The said submission is placed on record. 9. In that light, the petitions stand disposed.
