JUSTICE T.P.VIVEKANANDA ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) This Contempt of Court Case is filed alleging non- compliance of the directions issued by the learned Single Judge in Annexure-A judgment dated 08.04.2021 passed in W.P. No.10343/2021 (S-Res). 2. The paragraph No.6 of Annexure-A judgment reads as follows: "The 6th respondent- institution is hereby directed to pay the petitioner the arrears of salary, if not for the entire extent, atleast 50% of the salary, since it is clear that - 4 - HC-KAR CNR: KAHC010168332023 NC: 2026:KHC:45195-DB CCC No. 332 of 2023 although the Joint Director had written to the 6th respondent on 7-11-2018 at Annexure-E, to discontinue the service of the one SDC post, the Institution has continued the petitioner in its services. At the same time, the respondents-State shall also consider payment of a portion of the arrears of the salary having regard to the peculiar facts and circumstances of this case." 3. Learned counsel appearing for the complainants submits that 50% of the salary has been paid by accused No.6 and that the second aspect with regard to consideration of the payment of 50% by the State has not been complied with. However, learned Government Advocate appearing on behalf of respondents No.1 to 4 submits that the question of payment of 50% by the State Government has been considered and an endorsement has been issued on 26.05.2023 stating that the State is not bound to make the payment. 4. In the above view of the matter, we are of the opinion that since the direction was to the State to consider the payment and since the consideration has already been done, the contempt will not survive for consideration. The Contempt of Court Case is accordingly closed, leaving open the contentions of the complainants and their right to challenge the - 5 - HC-KAR CNR: KAHC010168332023 NC: 2026:KHC:45195-DB CCC No. 332 of 2023 endorsement, if so advised.
