ORAL ORDER
1. Accused in Crime No.159/2026 was registered by Magadi Road Police Station, Bengaluru City, for the offences punishable under Sections 78, 351(2), 352 of BNS, 2023, and Section 12 of the POCSO Act, 2012, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the petitioner and the learned HCGP for respondent no.1. Respondent no.2 though served in the matter, has remained unrepresented before this Court. 3. FIR in Crime No.159/2026 was registered by Magadi Road Police Station, Bengaluru, for the aforesaid offences against the petitioner herein based on the first information dated 24.06.2026 received from respondent no.2 - mother of the victim girl aged 17 years. In the said case, petitioner was arrested on 24.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in

Crl. Misc. No.6775/2026 was rejected on
22.07.2026. Therefore, petitioner is before this Court. 4.
Perusal of the allegations found in the first information would go to show that the daughter of the first informant aged 17 years who had failed in Tenth Standard, was attending her tuition classes. Petitioner allegedly used to follow her and pester her to love him. He also allegedly threatened her with dire consequences if she does not love him. On 22.06.2026, petitioner who had come near the tuition class of the victim girl, had threatened her of throwing acid on her if she does not love him. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences based on the first information submitted by the mother of the victim girl. The statement of victim girl has been recorded in the present case subsequently on 01.07.2026, wherein she has reiterated the averments found in the first information. 5. Petitioner, aged 27 years has no criminal antecedents. He is in custody in the present case for the last more than two months. Maximum punishment for the alleged offences is

imprisonment for a period of five years. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
6. Petition is allowed.
Petitioner is directed to be enlarged on bail in Crime No.159/2026 was registered by Magadi Road Police Station, Bengaluru City, for the offences punishable under Sections 78, 351(2), 352 of BNS, 2023, and Section 12 of the POCSO Act, 2012, subject to the following conditions:
a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons;
c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) Petitioner shall not involve in similar offences in future;

e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
