This second appeal has been preferred against the impugned judgment & decree dated 15.12.2016 passed by the learned ASHOK SAHU Digitally signed by ASHOK SAHU Date: 2026.09.26 14:05:45 +0530 2 Additional District Judge, Sarangarh, District Raigarh in Civil Appeal No.05-A/2015. 2. The matter is pending for compliance of the defaults pointed out by the Registry Note dated 21.03.2017 & the R(J) Note dated 25.04.2017. This Court by orders dated 09.05.2017, 13.07.2017, 12.10.2017 & 21.11.2017 granted time to remove the defaults, but despite ample opportunities granted, the defaults have not been cured and continue to remain as it is. The continuous non- compliance of the orders reflects a lack of due negligence on the part of the appellant in prosecuting the matter. 3. Today, when the matter is called for hearing twice, none appeared nor any representation is made on behalf of the appellant; therefore, this Court has no other option except to dismiss this appeal for want of prosecution. 4.
