Chakraborty, learned CGC appearing for the respondents has pointed out that as per Section 3(o) and Section 14 of the Armed Forces Tribunal Act, 2007 all service matters pertaining to Armed Forces are to be filed before the Armed Forces Tribunal. The issues raised by the writ petitioner in the present writ petition is non- inclusion of the name of petitioner’s second wife in the pension papers of the writ petitioner. Being aggrieved the present writ petition has been filed. Perusal of the relevant sections of the Armed Forces Tribunal Act, 2007 reveals that the matter ought to have been filed before the Armed Forces Tribunal. Mr. R. Baruah, learned counsel for the petitioner fairly submits that he be permitted to withdraw this writ petition and file afresh before the Armed Forces Tribunal. Accordingly, as prayer made, this writ petition stands dismissed on withdrawal, permitting the petitioner to approach the Armed Forces Tribunal, Guwahati and pursue his claims accordingly.
