WPLRT No. 17 of 2026
Md. Jamaluddin and others -vs- The State of West Bengal and others
For the petitioners : Mr. Mukteswar Maity, Ms. Manika Sarkar.
For the State : Sk. Md. Galib, Sr. Govt. Adv., Ms. Ashmita Chakraborty.
Heard on : February 11, 2026. Judgment on : February 11, 2026.
Sabyasachi Bhattacharyya, J.:
1. In the present writ petition, a prayer has been made for expeditious disposal of OA No. 3285 of 2024 (LRTT).
2. Learned Senior Government Advocate, appearing for the State, points out that vide order dated January 20, 2025, it was
2 recorded by the West Bengal Land Reforms and Tenancy Tribunal that although the original application was time-barred, no application for condonation of delay had been filed by the petitioners, for which liberty was granted to the petitioners, along with a liberty to the respondents to file affidavit-in- opposition against such condonation application, as and when filed.
3. We find from the order dated January 20, 2025 that till that date, no application for condonation of delay had even been filed by the writ petitioners.
4. Thus, no aspersion of delay in hearing the original application can be cast against the Tribunal.
5. Accordingly, there is no scope of any order being passed in terms of the prayer made in the writ petition.
6. However, we hope and trust that the Tribunal shall take up the application for condonation of delay, if filed, on the next date fixed, that is, on June 25, 2026, and dispose of the same as expeditiously as the business of the Tribunal permits. Thereafter, the learned Tribunal is requested to dispose of the main original application within a reasonable period.
3
7. To facilitate early hearing, the respondents are directed to file their affidavit(s)-in-opposition to the condonation application (if already filed by the writ petitioners before the Tribunal) within three weeks from date.
8. WPLRT No. 17 of 2026 is disposed of in the light of the above observations.
9. There will be no order as to costs.
10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties at an early date.
I agree.
