This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Additional District Judge, Fast Track Court, 6th Court at Alipore to dispose of the interlocutory applications filed in Ejectment Appeal No. 55 of 2024 expeditiously. Mr. Bhattacharya, learned advocate appearing for the petitioner submits that the eviction suit stood decreed and the opposite-party preferred an appeal being Ejectment Appeal No. 55 of 2024 and obtained an order of stay of all further proceedings of the execution case subject to payment of occupation charges. He submits that the opposite-parties have defaulted in payment of occupation charges and for such reason the applications have been filed one dated May 20, 2025 and the other dated February 18, 2026 for vacating the stay order. He submits that the aforesaid applications are still pending.
2 In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite parties or upon the learned advocate representing them before the learned judge of the appellate court forthwith. In the light of the submission made by the learned advocate appearing for the petitioner this civil revision application stands disposed of by requesting the learned Additional District Judge, Fast Track Court, 6th Court at Alipore to take up the hearing of the petitions dated May 20, 2025 and February 18, 2026 on the next date fixed, i.e., on October 5, 2026 and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the said applications, the learned Judge of the appellate court shall make an endeavour to dispose of the Ejectment Appeal No. 55 of 2024 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
