JUSTICE T.P.VIVEKANANDA - 3 - HC-KAR CNR: KAHC010700562025 NC: 2026:KHC:45528 WP No. 32421 of 2025 ORAL ORDER Petitioner is before this Court seeking for writ of mandamus, directing the respondents to release/return of the original registered GPA dated 24.06.2011 registered as Document No.P-1564/2011-12 in the office of respondent No.3. 2. The reason for holding back the registered instrument by the respondent authorities for 15 long years is not forthcoming from the writ petition papers. After the petitioner submitted the representation on 06.11.2024, requesting to release the registered instrument or furnish the copy of GPA at Annexure-A, respondent No.3 has forwarded the said request to respondent No.2 seeking necessary guidance for release of the registered instrument. In the said communication, it is stated that the revenue records in respect of the GPA schedule properties are standing in the name of different persons except the RTC in respect of 348/P2, which is standing in the name of the vendor of the petitioner. 3. Learned AGA, on instructions, submits that pursuant to the communication dated 05.06.2025 of respondent No.3 to respondent No.2, respondent No.2 will now - 4 - HC-KAR CNR: KAHC010700562025 NC: 2026:KHC:45528 WP No. 32421 of 2025 look into the request of the petitioner for release of the document in accordance with law, subject to the petitioner producing before respondent No.2, the relevant revenue records concerning the subject land, which was standing in the name of the executant of general power of attorney dated 24.06.2011. The petitioner is at liberty to produce necessary revenue records and documents concerning the relationship between the persons in whose names the revenue records are standing, so also, the persons who have executed the GPA referred to supra. 4. If such documents and information are furnished to respondent No. 2, respondent No. 2 shall pass necessary orders or take a decision to release the documents in accordance with law. If for any reason, respondent No.2 finds that the document cannot be released, necessary communication may be made to the petitioner, so that, the petitioner could challenge the decision of respondent No.2. 5. The petitioner is also at liberty to produce any revenue records which corresponds the survey numbers and the name of the village indicated in the GPA. - 5 - HC-KAR CNR: KAHC010700562025 NC: 2026:KHC:45528 WP No. 32421 of 2025 The entire exercise shall be completed within a period of three months from the date of receipt of certified copy of this order.
