Mrs. Tapasi Palit Sinha, learned advocate, who usually appears on behalf of the State and is present in Court today, is requested to represent the State in this matter. The concerned authority is requested to regularise her appointment in this matter. The petitioner is directed to serve a copy of this application along with annexure thereto upon Mrs. Palit Sinha in course of this day. Learned counsel for the petitioner submits that the private respondent is raising a pucca construction under Banglar Bari Scheme in excess of the area permitted in the said Scheme. Learned counsel for the private respondent denies and disputes the allegation of the petitioner. On prayer of the petitioner, liberty is granted to submit a comprehensive representation ventilating his grievance before the concerned authority within a week from date. The Block Development Officer, Canning Block, being the 5th respondent herein, is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event it is found that the private respondent is raising construction in excess of the Scheme allotted in his favour, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
