This Petition has been filed for transfer of Miscellaneous Criminal Case No.3/2024 filed under Section 12 of Protection of Women from Domestic Violence Act, 2005 pending before Judicial Magistrate First Class, Dabhra, District Janjgir Champa, C.G. to the Court of Judicial Magistrate First Class, Bilaspur District Bilaspur C.G. 2. At the outset, counsel for the petitioner would submit that petitioner/husband had earlier filed transfer petitions bearing No.TPCR AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.01.07 13:51:46 +0530 2 No.4 of 2025 and TPCR No.5 of 2025, in which, respondent/wife had brought to the notice of the Court that TPC No.220/2024 filed by the wife was allowed by the Coordinate Bench, by way of which, another case No. 722/2024 was transferred to Family Court at Sakti from District Durg. Learned counsel for the petitioner submits that therefore the wife had made a request for transfer of the aforesaid two criminal cases to District Sakti. Learned counsel further submits that this case may also be transferred to Judicial Magistrate First Class, Sakti as there are other cases already pending for consideration there. 3. Taking into consideration the aforesaid facts, as this Court vide order dated 09.06.2025 passed in TPCR No.4 of 2025 and TPCR No.5 of 2025, for the convenience of the parties and that the cases be tried at one place allowed the prayer made by the wife and the case was transferred at Sakti. Therefore, this Court finds it appropriate to transfer Miscellaneous Criminal Case No.3/2024 pending before Judicial Magistrate First Class, Dabhra, District Janjgir Champa, C.G. to the Court of Judicial Magistrate First Class, Sakti, District Sakti. Ordered accordingly. 4. Both the parties are directed to remain present before the Judicial Magistrate First Class, Sakti, District Sakti as on 24 th March, 2026 . 5. Counsel for the petitioner is directed to file copy this order before both the Courts for its compliance. 6. Accordingly, the Transfer Petition is disposed of. 7. All pending application, if any, also stand disposed of. 8. The respondent/husband would be at liberty to participate in the 3 proceedings through video conferencing/virtually unless otherwise directed by the concerned Court.
