Accused no.2 in S.C.No.1261 of 2016 pending before the Court of LXVI Additional City Civil & Sessions Judge, Bengaluru, arising out of Crime No.269 of 2012 registered by Vidyaranyapura Police Station, Bengaluru City, for offences punishable under Sections 324, 395, 397, 448, 342 of IPC is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that, petitioner who was arrested in the present case at the crime stage was granted regular bail by this Court in Criminal Petition No.2969 of 2013, vide order dated 13.06.2013. Subsequently, the case was committed to the jurisdictional Sessions Court and was numbered in S.C.No.408 of 2013. It appears that since the petitioner had not appeared before the Trial Court in S.C.No.408 of 2013, a split-up case was registered against him in S.C.No.1261 of 2016 and coercive - 3 - HC-KAR CNR: KAHC010529522026 NC: 2026:KHC:46699 CRL.P No. 11677 of 2026 steps were taken as against him. His presence was secured in S.C.No.1261 of 2026 on 28.01.2026. On the said date, he was remanded to judicial custody. His bail application filed thereafter has been now rejected. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, the other accused persons who were tried in S.C.No.408 of 2013 for the charge sheet offences have been acquitted by the Trial Court by judgment and order dated 03.02.2020. It is not in dispute that the petitioner has no other criminal antecedents. He has undertaken to cooperate before the Trial Court for speedy disposal of the case. For the mistake committed by the petitioner, he has been sufficiently punished. He is in custody for the last seven months. Under the circumstances, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.1261 of 2016 pending before the Court of LXVI Additional City Civil & Sessions Judge, Bengaluru, arising out of Crime No.269 of 2012 - 4 - HC-KAR CNR: KAHC010529522026 NC: 2026:KHC:46699 CRL.P No. 11677 of 2026 registered by Vidyaranyapura Police Station, Bengaluru City, for offences punishable under Sections 324, 395, 397, 448, 342 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off Sd/- (S VISHWAJITH SHETTY) JUDGE NMS./List No.: 1 Sl No.: 74
