The petitioner who is the Upa Pradhan of Sahajadpur Gram Panchayat has assailed the no confidence motion submitted by the private respondents/ members of the Panchayat for his removal on the ground that the motion is stigmatic. Learned counsel for the private respondents accedes to the contention of the petitioner. It appears that the motion contains stigma against the Upa Pradhan/petitioner and therefore cannot sustain in the eye of law. The motion submitted on July 31, 2026 is quashed/set aside. All consequential steps taken by the Prescribed Authority pursuant to the said motion are also set aside/quashed. However, liberty is granted to the private respondents/members to submit a fresh no confidence motion in terms of Section 12 of the West Bengal Panchayat Act, 1973. In the event such motion is submitted, the Prescribed Authority shall act in terms of the said provisions of law, particularly the timeframe mentioned therein. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
