1. Heard Mr. A Alim SK, learned counsel for the petitioner.

2. The present contempt petition is filed alleging willful and deliberate violation of the order dated 01.08.2022 passed in WP(C) No.4935/2022.
3. By the aforesaid order, the petitioner was directed to file a fresh appeal before the Secretary, Elementary Education Department, Assam within a period of 10 days from the date of the said order. Thereafter, the Secretary Elementary Education Department, Assam was to pass an order in accordance with law in the appeal. Such appeal was stated to have been filed on 04.08.2022.
4. Today when the matter is listed, Mr. PK Borah, learned counsel for the respondent No.2 has produced an order dated 18.04.2023, by which the appeal of the petitioner was decided with a direction to the Director of Elementary Education, Assam to take steps to issue order of de-merging Hazipara Girls LP School and 612 No. Nayeralga LP School under Dhubri District.
5. In view of the aforesaid, in the opinion of this court, the
order dated 01.08.2022 passed in WP(C) No.4935/2022 stands complied with.
6. It is needless to say that the petitioner shall be at liberty to assail such appellate speaking order before the appropriate forum, if so advised.
