The present writ petition has been filed for issuance of direction upon the respondents to pay the admitted dues of the petitioner to the tune of Rs.5,10,302/- with penal and compensatory interest in respect of construction work of Collectorate Building at Seraikela. 2. The petitioner appears to have executed the work in question as sub-contractor of Respondent- NBCC Ltd. 3. A counter affidavit has been filed on behalf of the respondent nos.2, 4, 5 & 6, stating, inter alia, that the assessed amount of 2026:JHHC:1023 2 Rs.4,49,066/- has been paid to NBCC Limited (wrongly mentioned as the petitioner) vide cheque no.169253 dated 23rd September, 2015, which was duly received by the representative of NBCC Limited on 23rd September, 2015 itself. 4. Another counter affidavit has been filed on behalf of Respondent- NBCC Limited (Respondent Nos.7 & 8), paragraph nos.23 & 24 of which read as under:- “23. That after long persuasions by NBCC at various levels and officers of Building Construction Department, Govt. of Jharkhand, finally the approval of final bill of NBCC has been accepted and released Rs.4,49,066.00 by the Executive Engineer, Building Construction Department, Saraikela on 23.09.2015. 24. That accordingly, NBCC has settled the final bill of M/s Rameshwaram and released the final bill payment as per their contract rates and NBCC paid Rs.417497.00 to M/s. Rameshwaram on 16.12.2015.” 5. Since as per the aforesaid statement, admitted amount of Rs.4,17,497/- has already been paid by Respondent- NBCC Limited to the petitioner on 16th December, 2015, there is no need to further proceed in the matter. 6.
