S/O PUTTEGOWDA FOR ANOTHER 60 DAYS. THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for the respondents. 2. The petitioner – detenu – Yogesha P (CTP No.01158) is before this Court seeking for the following reliefs: i) Issue a writ order or direction in the nature of mandamus to the Respondents to extend the general parole to Convict Prisoner No.1158 Yogesha .P. S/o Puttegowda for another 60 days. ii) Pass any other orders/directions considering the facts and circumstances of the case, together as to costs in the interest of justice and equity. 3. This Court had vide order dated 22.07.2026 in WP No.20176/2026 granted parole for 30 days on account of medical grounds. A medical report had been placed at Annexure-C to this petition indicating that operation has been carried out with laser lithotripsy and DJ stenting. - 3 - HC-KAR CNR: KAHC010591052026 NC: 2026:KHC:46277 WP No. 26645 of 2026 4. The submission made by the learned counsel for the petitioner is that the detenu would require continuous monitoring. 5. In view thereof, this Court passes the following: ORDER i) The Writ Petition is allowed. ii) It is explicitly made clear that in view of the extension of parole order, the detenu would not be required to surrender to the prison authorities on 01.09.2026 when the earlier parole granted by this court comes to an end. iii) The extension of the present parole is for a period of 60 days commencing from 01.09.2026 subject to the following conditions: a) The detenu - Yogesha P (CTP No.01158) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the detenu would evade going back to the gaol, after the expiry of the period of parole. - 4 - HC-KAR CNR: KAHC010591052026 NC: 2026:KHC:46277 WP No. 26645 of 2026 b) The Respondents shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iv) The Registry is directed to communicate the order to the prison authority for its immediate execution. v) The petitioner and family members of the detenu to comply with all other formalities.
