Mr. Dinesh Chauhan, learned AGA for the State. 3. Present bail application is moved by the applicant, who is in judicial custody in connection with Case Crime No.623 of 2025 under Sections 303(2), 317(2), 3(5) BNS 2023, Police Station SIDCUL, District Haridwar. 4. Heard learned counsel for the parties. 5. Learned counsel for the applicant submits that it is a case of motorcycle theft and applicant is not named in the FIR as the FIR is lodged against unknown person. He submits that the main accused persons are Saurabh and Sanjay, who confessed that they had stolen the said motorcycle. He submits that the main accused persons have not assigned any role to applicant and specifically stated that the said motorcycle was stolen by them. He also submits that there was no independent witness as the said motorcycles were kept in such a place which is easily accessible. He further submits that applicant is languishing in jail since 17.12.2025. 6. Learned State counsel opposed the bail application and submits that applicant has criminal history thus applicant should not be granted bail. 7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 8. Accordingly, bail application is allowed. Let the applicant-Sunil Kumar be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 9.
