COMMON ORDER:
Tr.C.M.P.No.169 of 2025 is filed by the petitioner / wife against the respondent / husband for seeking transfer of G.W.O.P.No.3 of 2025 pending on the file of the Family Court-cum-VIII Additional District Judge, Ongole, Prakasam District and transfer the same to the Family Court at Nellore, SPSR Nellore District. 2. Tr.C.M.P.No.170 of 2025 is filed by the petitioner / wife for seeking transfer of F.C.O.P.No.2 of 2025 pending on the file of the Family Court-cum- VIII Additional District Judge, Ongole, Prakasam District and transfer the same to the Family Court at Nellore, SPSR Nellore District. 3. The petitioner in both the petitions pleaded in the affidavit that she is the legally wedded wife of the respondent and their marriage took place on 02.05.2014 at Tirumala and they have been blessed with two daughters, aged about 11 and 8 years respectively and they are living with the petitioner herein. The petitioner pleaded that the respondent has instituted G.W.O.P.No.3 of 2025 for guardianship of minor daughters under Section 6 of the Hindu Minority and Guardianship Act, 1956 and the respondent also instituted F.C.O.P.No.2 of 2025 under Section 13 (1) (ia) of the Hindu Marriage Act, 1955 and both the said cases are pending before the Family Court-cum-VIII Additional District Judge at Ongole. 5

The petitioner further pleaded that she is currently residing at J.R.Peta near Nellore and the distance in between Nellore and Ongole is around 165 kms and it is very difficult to travel from Nellore to Ongole along with her two daughters, aged about 11 and 8 years respectively, to appear before the Family Court at Ongole in connection with aforesaid two pending cases viz., G.W.O.P.No.3 of 2025 and F.C.O.P.No.2 of 2025, and that she is constrained to file the present applications seeking transfer of G.W.O.P.No.3 of 2025 and F.C.O.P.No.2 of 2025 to the Family Court at Nellore. 5. Sri A.Tulsi Raj Gokul, learned counsel for the respondent appeared through virtual mode and represented that both the transfer applications may be disposed of on merits. He would contend that the distance between Ongole and Nellore is in between 150 and 200 kms and the respondent herein is ready to pay the travelling charges to the petitioner herein whenever she appeared before the Family Court at Ongole. 6. Heard both side counsels on record. 7. The undisputed facts are the respondent herein filed G.W.O.P.No.3 of 2025 on the file of the Family Court at Ongole for custody of minor daughters, aged about 9 and 7 years respectively. The respondent also filed F.C.O.P.No.2 of 2025 against the petitioner herein under Section 13 (1) (ia) of the Hindu Marriage Act, 1955 for seeking divorce from the petitioner herein. 8. The material available on record reveals that the petitioner / wife herein is residing at Nellore along with two minor daughters, aged about 11 and 8

years respectively and they are school going children and they are prosecuting their studies at Nellore. As noticed supra, the distance in between Ongole and Nellore is in between 150 kms and 200 kms. Therefore, it is very difficult for the petitioner on every date of adjournment to appear before the Family Court at Ongole along with two minor daughters, aged about 11 and 8 years respectively. 9.
Considering the facts and circumstances of the case, since the respondent herein is seeking custody of the children, who are aged about 11 and 8 years respectively and the said two minor daughters are prosecuting their studies at Nellore and they are also currently residing at Nellore along with their mother, therefore, this Court is of the considered view that it is just and necessary to allow both the transfer applications for seeking withdrawal of G.W.O.P.No.3 of 2025 and F.C.O.P.No.2 of 2025 on the file of the Family Court at Ongole and transfer the same to the Family Court at Nellore. 10. In the result, the present Transfer Civil Miscellaneous Petitions are allowed, and G.W.O.P.No.3 of 2025 and F.C.O.P.No.2 of 2025 on the file of the Family Court at Ongole are hereby withdrawn and transferred to the file of the Family Court at Nellore. The learned Judge, Family Court, Ongole shall transmit the case records in G.W.O.P.No.3 of 2025 and F.C.O.P.No.2 of 2025 to the file of learned Family Judge, Nellore, as expeditiously as possible, preferably within a period of one (01) week from the date of receipt of a copy of this order. Both the parties are directed to appear before the Family Court at Nellore on 21.08.2026 at 10.30 a.m. There shall be no order as to costs. 7
