having already sold the property, Tarwinder Singh, with deliberate dishonest intention and as the mastermind of the fraud and in connivance with Kimti Lal son of Sh. Shankar Das resident of H. No. 83/5, Bhargo Nagar, Jalandhar, Pardeep Kumar son of Sh. Faquir Chand resident of H. No.6, Aggarwal Farm, Model House, Jalandhar, executed another sale deed no 2381 dated 07.07.2022 in favor of Kimti Lal, thereby misrepresenting ownership and title over the said property, That Kimti Lal, acting upon the fraudulent transaction and in furtherance of the conspiracy, executed another power of attorney and agreement to sell dated 02.11.2022 in favor of Pardeep Kumar both the documents were dully witnessed by Tarwinder Singh POA Document No. 2022- 23/187/4/1331 on the same date in his favor in respect of the said property. 4. That thereafter, on 21.11.2022.
4. That thereafter, on 21.11.2022. Kimti Lal through his attorney sell the same property to Rubal Bajaj, vide sale deed Document No. 2022- 23/187/1/6330 and fraudulently obtained Rs. 10,00,000/- (Rupees Ten Lakh only) from me. 5. That when the complainant started to raise an construction over the property the Sanjeev Kumar came forward along with his sale deed then. On conducting an independent inquiry, I came to know that the property was already sold to Sanjeev Kumar much earlier on 19.04 2022 and the entire chain of transactions thereafter was fraudulent and illegal. 6. That it is now evident that the accused persons have acted in collusion with each other, with a common intention, and have committed a well-planned conspiracy to cheat and defraud me of my hard-earned money. 7 The actions of the accused persons amount to the commission of cognizable offences. 8. That the acts of the accused persons have cheated me for a valuable security and not only financial loss but also mental harassment and agony, and they have tried to unjustly enrich themselves at my cost. It is therefore prayed that the above accused person may kindly be punished for their illegal act and a conduct. Sd/- Rubal Bajaj…”

4.
Per contra, learned State counsel and learned counsel for the complainant have opposed the bail petition. It has been submitted that there is no intention of the petitioner to settle the matter. It has further been submitted that the petitioner sold his plot to two different persons thereby clearly showing his intention of cheating. It has been submitted that custodial interrogation would be required in the present matter.
5.
I have considered the submissions made by learned counsel for the parties.
6.
The allegations against the petitioner are very serious. He alienated his plot firstly to Sanjeev Kumar vide registered sale deed dated 19.04.2022 and thereafter to Kimti Lal vide registered sale deed dated
07.07.2022. Not only this, Kimti Lal executed a power of attorney and an agreement to sell dated 02.11.2022 in favour of one Pardeep Kumar and in both documents, one of the witnesses was the present petitioner. Had there been any intention on the part of the petitioner to settle the matter, he would have done so. Earlier also, a coordinate Bench had ordered the petitioner to join the investigation but he did not appear before the investigating authority as a result of which, the interim order was vacated.
7.
Keeping in view the nature of the allegations and the conduct of the petitioner, this Court does not find it to be a case where the concession of anticipatory bail should be extended.
8.
That being so, the petition is found to be devoid of merit and is accordingly dismissed.
However, nothing stated herein above shall be construed to be an opinion on the merits of the case.
