20 31.08. 2026 Ct. No. 18 Ab IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE. WPA 21840 of 2026 Pritam Saha Vs. The State of West Bengal and others. --------------- Mr. Sayan Banerjee, Mr. Monoj Adak. … for the petitioner. Mr. Lokenath Chatterjee, Ld. JSC, Mr. Indradeep Pal, Ms. Sneha Chatterjee. … for the State. 1. The affidavit of service filed today is taken on record. 2. The petitioner is aggrieved that he has been placed in a draft post, which is 56 kilometers away from his place of residence. 3. The petitioner has been engaged mostly in Group-D post on a contractual basis for a period of a year in various posts since 2014. 4. The present posting of the petitioner is approximately 56 kilometers from his place of residence for which the petitioner seeks some consideration as the health of the petitioner’s father is rather precarious. 5. Admittedly, the transfer is not a matter of right neither is family inconvenience of an employee a ground for transfer. 6. The petitioner’s tenure at the present post will end sometime in November 2026, as submitted by Mr. 2 Chatterjee, learned Junior Standing Counsel, appearing for the respondent authorities. 7. The petitioner may seek a closer and more convenient posting from the authorities at the end of the tenure of the present posting. However, there is no question of transferring the petitioner as sought in the writ petition. 8. The writ petition fails and is, accordingly, dismissed. 9. There shall, however, be no order as to costs. 10. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Reetobroto Kumar Mitra, J.)
