The petition being arguable is admitted for hearing. 3. We have heard learned counsel for the State/petitioner and perused the judgment passed by the trial Court as well as related documents. 2 4. Considering the statements of PW-5 and PW-8 and the submission of learned counsel for the State/petitioner that the deceased had informed PW-5 about the alleged incident, whose evidence falls within the ambit of Section 6 of the Indian Evidence Act, 1872, and considering the relevancy of the fact forming part of the same transaction, as such the learned trial Court ought not to have ignored this vital piece of evidence. Accordingly, the leave, as prayed for by learned counsel for the State/petitioner, is granted. 5. The Registry is directed to register the present CrMP under the head “Acquittal Appeal”. 6. After registration of the acquittal appeal, issue notice to the respondent/accused by ordinary as well as registered mode within a week. PF be paid within ten days from the date of registration of the acquittal appeal for issuance of notice to respondent/accused. 7. In view of the above, present CRMP stand disposed of. 8.
