VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 02.12.2024 [impugned order] passed in Writ Petition No.32053/2024 (GM-RES). The - 3 - HC-KAR NC: 2026:KHC:21191-DB CCC No. 430 of 2025 complainant had filed the said petition, inter alia, praying that directions be issued to the accused to release the outstanding payment of a sum of `1,72,52,164/- (Rupees One Crore Seventy Two Lakhs Fifty Two Thousand One Hundred and Sixty Four only) by accepting the representation. The said petition was disposed of with a direction to the accused to consider the complainant's representation and pass appropriate orders in accordance with law. 2. Accused No.1 has filed compliance affidavit and an additional compliance affidavit. 3. The compliance affidavits indicate that pursuant to the directions issued by this Court, an endorsement dated 15.05.2025 was issued wherein it is stated that the file has been submitted to the Covid Commission constituted by the Government of Karnataka for opinion. Thereafter, the department had conducted a pre-audit by a Committee comprising of Chief Vigilance Officer, Chief Account Officer cum Financial Adviser and Deputy Director EMS, which has alleged that certain irregularities were found. Thereafter, the same was informed to the complainant by an endorsement dated 02.06.2025. - 4 - HC-KAR NC: 2026:KHC:21191-DB CCC No. 430 of 2025 4. The additional compliance affidavit also indicates that the complainant's claim had been examined. 5. In view of the above, we are unable to accept that any proceedings under Contempt of Courts Act, 1971, are required to be initiated against the accused. 6. The complaint is, accordingly, closed. 7. We, however, clarify that this will not preclude the complainant from availing of its remedies, in the event, if it is aggrieved by any of the endorsements issued by the accused or pursuing its claims, in accordance with law.
