This revisional application seeks expeditious disposal of an application for injunction filed under Order 39 Rule 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908 in Title Suit No.64 of 2025 pending before the learned Civil Judge (Senior Division) at Sealdah. 2. Learned advocate appearing for the petitioners submits that the petitioners have instituted Title Suit No.64 of 2025 for a decree for declaration and injunction and an application for temporary injunction has also been filed in connection therewith, which has been kept pending since April 1, 2025. 3. It is submitted that the defendants/opposite parties have filed an application under Order 7 Rule 11 of the Code seeking rejection of plaint and as such, the entire suit has been stalled. It is submitted that neither the Order 7 Rule 11 application has been disposed of nor the injunction application. 4. In view of the nature of the order proposed to be passed, prior service of notice of the revisional application along with a notice is not being directed, however, the petitioners shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite parties within a week from date. 5. Having heard the learned advocate appearing for the petitioners and having considered the material on record, the learned Civil Judge (Senior Division) at Sealdah is requested to dispose of the application under Order 7 Rule 11 of the Code of Civil Procedure, 1908 as expeditiously as possible and preferably within a period of one month from the next date fixed. The learned Trial Court is further requested to dispose of the petitioners’ application under Order 39 Rule 1 and 2 of the Code as expeditiously as possible and preferably within a period of one month from the date of disposal of the application under Order 7 Rule 11 of the Code. 6. CO 977 of 2026 stands disposed of with the above observations. No costs. 7. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.) 2
