ORDER ON BOARD 22/09/2026
1. Petitioner by way of this petition prayed for following reliefs.
“(i) to call for the entire record and the case diary of Crime No. 630/2025 registered at police station PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA
2 / 3 Supela, District Durg (C.G.) together with the closure report bearing Closure No. 264/2025 dated
30.12.2025. (ii) Be pleased to set aside the closure report bearing Closure No. 264/2025 dated 30.12.2025 submitted by Respondent no. 2 and direct a further and complete investigation into Crime No. 630/2025 through an independent investigating agency in preference to police station Supela District Durg, C.G. (iii) Be pleased to direct that Section 338, 336(3) and 316(2) of the Bhartiya Nyaya Samhita, 2023 together with the appropriate provisions of the Information Technology Act, 2000 be added against Respondents No. 3 to 6 in the said Crime No. 630/2025. (iv) Be pleased to direct a specific enquiry into the identity and existence of Shri Sanjay Kumar and into the genuineness of every document issued in his name, particularly in the light of the fact-appearing from the case diary itself-that the notices issued by the investigating agency to the said Shri Sanjay Kumar at each of the addresses disclosed in the Trust Deed, the Supplementary Trust Deed and the connected documents were returned unserved. (v) Be pleased to direct the arrest and custodial interrogation of Respondents No. 3 to 6 in the said Crime No. 630/2025 and the tracing and attachment of the proceeds of the offence. (vi) Be pleased to pass such further or other order or orders as this Hon’ble Court may deem just, fit and proper in the facts and circumstances of the case, in the interest of justice.”

From perusal of the pleadings and the documents available in record, it appears that petitioner has approached this Court upon filing of the closure report by the investigating agency in which the investigating agency has submitted closure report on 30.12.2025 stating that there is lack of evidence for submitting the charge-sheet against the accused persons therein for alleged commission of offence under Sections 338, 336(3) and 316(2) of Bhartiya Nyaya Samhita, 2023.

3. It is not submitted by learned counsel for petitioner that the closure report submitted is whether accepted by the court by passing any order nor any
order in this regard has been placed in this petition.
4. According to the provisions under law, it is for the jurisdictional Magistrate whether to accept the closure report submitted based on the material available in the final report or not and therefore the prayer made by petitioner in this petition, in the opinion of this Court and in the facts of the case appears to be pre-mature.
5. Accordingly, this petition being devoid of substance is liable to be and is hereby dismissed. Sd/- (Parth Prateem Sahu) pwn
