(2) Petitioner was employed as Clerk in Multipurpose Nandpur Khempur Kisan Sewa Cooperative Society, Udham Singh Nagar. He was put under suspension vide order dated 31.3.2022, which was reportedly passed pursuant to direction issued by District Assistant Registrar. Suspension order passed against the petitioner was however stayed by this Court, vide order dated 23.8.2023. By that order, respondents were directed to take decision about the retiral dues of the petitioner, uninfluenced by the suspension order. Petitioner has retired from service on 31.10.2022, but no amount has been paid to him towards gratuity, provident fund and other terminal dues. (3) Learned Counsel for the petitioner submits that for the similar charge, two employees were suspended, namely, petitioner and one Naxe Ali, however order of suspension passed in respect of Naxe Ali was revoked on 19.9.2022 and after his retirement, all his terminal dues have been released. He submits that petitioner is identically placed, therefore there is no reason or justification whatsoever for withholding the dues payable to petitioner. (4) Mr. Yogesh Pandey, learned 2026:UHC:3096 Counsel appearing for the respondent no. 4 and 5, submits that petitioner can raise his grievance before the District Assistant Registrar, Udham Singh Nagar, who shall pass necessary orders in the matter. (5) Writ petition is, accordingly, disposed of by permitting the petitioner to make representation to District Assistant Registrar, Udham Singh Nagar. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within six weeks thereafter.
