By the present petition, the petitioners have prayed for following reliefs:- 5 “10.1 It is therefore prayed that this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/ direction and direct the state/ respondent no.2 to 4 to grant the benefit of pay scale of Rs.4750-7440 grade pay of Rs. 1300, revised pay scale of Rs. 15600- 49400 immediately on completion of three years of the service from initial date of appointment as it is granted to Bhritya Karmis of Ambikapur vide order dated 28.06.2022 (P/4) and as per order dated 10.05.1984 (annexure 2). 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to pay arrears of salary difference with interest e.g. 9% p.a. from respective eligibility dates till payment. 10.3 It is therefore prayed that this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/ direction and direct the state/ respondent no.2 to decide the representations of the petitioners (P/8) 10.4 Any other relief which this Hon'ble Court may deem fit.” 2. Learned counsel for the petitioners submits that the petitioners, belonging to Special Backward Tribes, were engaged as on collector-rate/contract basis and posted as Peons. The State had decided that such employees belonging to backward tribes 6 and posted in Ashrams/Hostels would be extended benefits similar to Shiksha Karmis, except for the benefit of Kramonnati, and would be designated as Bhritya Karmis. However, the said benefits were subsequently denied to the Bhritya Karmis. Respondent No. 3 sought guidelines from Respondent No. 2 regarding grant of the pay scale of Rs. 15,600–49,400 to the petitioners. Pursuant to the State Government's directions dated 10.05.1984, contingency-paid employees completing three years of service were to be granted permanent status and the revised pay scale. The Collector (Adivasi Vibhag), Ambikapur, District Surguja (C.G.), had extended the revised pay scale to similarly situated employees upon completion of three years of service. However, despite repeated representations, the said benefit has not been extended to the petitioners. Hence, direction be issued to the respondents authorities to take decision on the representation submitted by petitioners at the earliest within specified time frame. 3. Learned State counsel submits that in view of the limited prayer made by leaned counsel for petitioners, he is having no objection. 4. On due consideration of the submission of learned counsel for parties and looking to the nature of grievance raised, this writ petition at this stage is disposed of directing respondent No.2 to take decision on the pending representation (Annexure P-8) submitted by petitioners, in accordance with law, expeditiously 7 preferably within further period of six months from the date of receipt of this order.
