The prayer in the present petition under Section 528 BNSS (Section 482 Cr.P.C.) is for quashing of the impugned order dated 18.10.2025 (Annexure P-2) passed by the Judicial Magistrate Ist Class, Ludhiana whereby the petitioner has been declared a proclaimed offender in case FIR No.47 dated 16.04.2023 under Sections 419, 420, 467, 468, 471, 447, 511 and 120-B IPC (Sections 319, 318(4), 338, 336(3), 340(2), 329, 62 and 61 BNS) registered at Police Station Meherban, Ludhiana, Police Commissionerate. 2. CRM-M-49431-2026 (O & M) ::2:: concession of anticipatory bail but withdrew his petitions. As the dispute is of a civil nature and has been given a criminal colour, the impugned order dated 18.10.2025 (Annexure P-2) is liable to be quashed. 3. I have heard the learned counsel for the petitioner. 4. Admittedly, the petitioner is an accused in the captioned FIR. A perusal of the impugned order dated 18.10.2025 (Annexure P-2) would reveal that the same has been passed after due compliance of all the necessary legal requirements. It seems that the petitioner had gone abroad on 30.04.2023 i.e. after the complaint was filed on 13.03.2023 leading to the registration of the FIR on 16.04.2023. In fact, a perusal of his passport (Annexure P-3) would reveal that the same was issued only on 10.04.2023. 5. In view of the aforementioned facts, I find no merit in the present petition and the same stands dismissed. 6. The pending application(s), if any, shall stand disposed of accordingly.
