1. Applicant has preferred this application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.130/2026 registered at Police Station – Kotwali, District - Rajnandgaon (C.G.) for the offence punishable under Sections 318(4), 108 and 3(5) of BNS, 2023.

The prosecution story, in brief, is that on 18.12.2025, information was received from Police Station City Kotwali, Durg, regarding the death of deceased Komal Sahu, aged about 55 years, resident of Rajnandgaon, who had allegedly consumed poison on 17.10.2025 at Municipal School Ground, Rajnandgaon, and died during VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.09.26 14:31:37 +0530
2 treatment on 21.11.2025 at District Hospital, Durg. Accordingly, a Marg intimation under Section 194 of the BNSS was recorded. During the course of the Marg inquiry, it was alleged that the deceased had collected money from several persons on the pretext of investing the same in share trading for high returns and had transferred the amounts to co-accused Aziz Khan, resident of Indore. As Aziz Khan allegedly failed to return the money, the deceased came under financial pressure and committed suicide. During the inquiry, a suicide note was produced by the wife of the deceased, wherein the names of Aziz Khan and several other persons, including the present applicant and his family members, were allegedly mentioned. On the basis of the aforesaid allegations, FIR bearing Crime No. 130/2026 was registered on
28.02.2026.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present crime. He further submits that the allegations against the applicant are identical to those against co-accused Sheetal Kumar Shau, who has been granted anticipatory bail in MCRCA No. 14555 of 2026 vide order dated 10.09.2026. Therefore, he prays that the applicant may also be extended the benefit of anticipatory bail.
4. Learned State Counsel opposes the submissions made by learned counsel for the applicant, however, he does not dispute the submission that the allegations against the applicant are similar to those against co-accused Sheetal Kumar Shau, who has already been granted anticipatory bail.

5. Upon a query being made, learned counsel for the State submits that the applicant has no criminal antecedents.
6. I have heard learned counsel for the respective parties.
7. On due consideration of the facts and circumstances of the case, nature of allegation, submission of learned counsel for the parties, without commenting anything on merits, I am inclined to allow this anticipatory bail application.

Accordingly, application is allowed and it is directed that in the event of arrest of applicant in connection with the crime in question (130/2026), he shall be released on anticipatory bail by the Officer arresting him on his executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting Officer. Applicant shall also abide by the following conditions: (i) that the applicant shall make himself available for interrogation before the Investigation Officer as and when required; (ii) that the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him/her from disclosing such
facts to the Court or to any police officer; (iii) that the applicant shall not act, in any manner, which will be prejudicial to fair and expeditious trial; and (iv) that the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
