Mr. Jahangir Ganai, learned Senior Counsel appearing for the petitioner, after addressing arguments for some time, submits that the petitioner would feel satisfied if the present writ petition is treated as a representation and disposed of at this stage with a direction to respondent No. 2, i.e., Director, Floriculture, Gardens and Parks Department, Polo View, Srinagar, J&K, to decide the same in accordance with Government Order No. 17-Flori/G&P of 2018 dated 23.02.2018, with particular reference to Clause 11 thereof, within some reasonable period. 2. For the sake of convenience, Clause 11 of Government Order dated 23.02.2018 (supra) is extracted hereunder: “11. The permission issued shall be non-transferable. However, in case of death/handicap of a photographer, permission can be transferred to the NOK of the permission holder, subject to the condition that he/she is registered with the Tourism Department under TTA, 1978 in the photography trade. In the case of adopted sons, the Muslim Personal Law of 2007 shall be binding.” 3. Mr. Alla-ud-din Ganai, learned AAG, on the asking of the Court, appears on behalf of the respondents and submits that he has no objection to the disposal of the writ petition in the manner proposed by learned Senior Counsel for the petitioner. However, he submits that the case of the petitioner shall be considered strictly in accordance with the applicable rules and governing law. 4. In view of the above and with the consent of learned counsel for the parties, the writ petition is taken up for final disposal and is accordingly disposed of with a direction to respondent No. 2, Director, Floriculture, Gardens and Parks Department, Polo View, Srinagar, J&K, to treat the writ petition as a representation on behalf of the petitioner and decide the same strictly in accordance with Government Order No. 17-Flori/G&P of 2018 dated 23.02.2018, particularly Clause 11 thereof, within a period of four weeks from the date a copy of this order, along with the writ petition and its annexures, are made available to respondent No. 2. It is further directed that a copy of consideration order, which is likely to be passed, be forwarded to the petitioner through registered post within one week thereafter. 5.
