Mr. Mandal, learned advocate appearing for the petitioner prays for leave to amend the cause title of the civil revisional application. Such leave is granted. Leave is granted to the learned advocate on record of the petitioner to amend the cause title of the civil revisional application here and now. This application under Article 227 of the Constitution of India is at the instance of the plaintiff no.1 praying for a direction upon the learned Civil Judge (Sr. Div.), 2nd Court at Alipore to dispose of the Title Suit No.415 of 2021 expeditiously. From the order dated May 6, 2026, it appears that the said date was fixed for hearing on the point of acceptance of the written statement and for filing of the written objection in respect of such application. The said order further reflects that an application under Section 10 of Code of Civil Procedure at the instance of the defendant nos.1 to 4 is pending. It also appears from the said order that on September 22, 2025 an application has been filed under Section 151 of the Code of Civil Procedure on behalf

of the defendant nos.1 and 2 of Title Suit No.753 of 2019 praying for analogous hearing of Title Suit No.415 of 2021 with Title Suit No.753 of 2019. Mr. Mandal, learned advocate appearing for the petitioner submits that the aforesaid applications are all pending. He further submits that a direction be passed upon the learned judge to dispose of the suit expeditiously. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2792 of 2026 stands disposed of by requesting the learned Civil Judge (Sr.
Div.), 2nd Court at Alipore to take up the hearing of the pending interlocutory applications, if the same are otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Depending on the fate of the applications under Section 10 of the Code of Civil Procedure Code and the application under Section 151 of the Code of Civil Procedure praying for analogous hearing of the two suits, the learned trial judge shall proceed in accordance with law. There will be no order as to costs. 3
