1. By the present petition, the petitioners have prayed for following reliefs:
“10.1) That, this Hon'ble Court may kindly be pleased to issue the direction for the respondent authorities to grant the benefit of first-time scale pay. 10.2) That, this Hon'ble Court may kindly be pleased to issue the direction for the respondent authorities to grant interest on delay payment of benefit of time scale pay. 10.3) Any other relief as this Hon'ble Court may be pleased to grant.”

Learned counsel for the petitioners submits that the petitioners were appointed on the post of Gangman, as a daily wagers
3 and their services were regularized by the respondent No.3 on the post of Labour under the work charge and contingency paid employees. Petitioners joined their duties on their respective post, however, even after completion of 10 years of their service they were not provided benefit of first time pay scale as per the circular of the State Govt. He submits that many of the similarly situated employees have been granted benefit. The petitioners were retired after attaining the age of superannuation. Learned counsel further submits that the petitioners may be permitted to submit representations before the respondent authorities and that a direction may be issued to the respondent authorities to consider and decide the same in accordance with law.

Learned counsel for the State submits that, in view of the limited prayer made by learned counsel for the petitioners, if the petitioners approach the respondent authorities, the same shall be considered in accordance with law, subject to verification of the facts.
4. I have heard learned counsel for the parties, perused the pleadings and documents.
5. Taking into consideration the prayer made by learned counsel for the petitioners, the present writ petition is disposed of at this stage with liberty to the petitioners to approach the respondent authorities by submitting a representation along
4 with details of their appointment and regularization within 30 days. Thereafter, the respondents/State shall, after verifying the cases of the petitioners, consider their entitlement to the benefit of the First Time Bound Pay Scale in terms of the Circular dated 04.05.2012 and pass appropriate orders in accordance with law, within a period of five months from the date of receipt of such representations.
