consideration. However, no substantial question of law was formulated. It is an appeal under Section 30 of the Employees’ Compensation Act, 1923, which needs that in the appeal, there has to be involvement of a substantial question of law. Thus, this Court formulates the following substantial question of law:
“Whether the learned Commissioner for Employees Compensation–cum-Labour Court, Dhamtari (CG) has committed an error in law in dismissing the application Digitally signed by GOPAL SINGH Date: 2026.09.26 17:07:45 +0530
2 / 2 Gopal under Section 10 of the Employees’ Compensation Act, 1923 filed by the appellants/claimants holding that there was no employee and employer relationship between deceased Kanhaiya and respondents No.1 and 2 and also erred in holding that the death of deceased Kanhaiya has not occurred during the course of and arising out of the employment with respondents No.1 and 2?” With the consent of learned counsel appearing for the parties, the appeal is heard finally.
