1. This MCC has been filed seeking modification of the operative part of paragraph No.7 of the order dated 03.08.2026 passed by this Court in Writ Petition (S) No.9519 of 2025 and other connected matters.
2.
Learned counsel for the petitioners submits that the aforesaid writ petition was finally decided and disposed of by this Court vide
order dated 03.08.2026. She submits that while passing the aforesaid order, the operative part of paragraph No.7 contains the words “as well as the law laid down by the Hon'ble Supreme Court in Uma Devi (Supra)”. She further submits that the Department of Finance, State of Chhattisgarh, had requested the Department of General Administration to re-examine the matter in the light of the judgment passed by the Hon'ble Supreme Court in State of Karnataka and Others Vs. Uma Devi and Others, and thereafter, a meeting was convened by the General Administration
3 Department on 24.09.2024.
3.
Learned counsel further submits that in the said meeting, the General Administration Department had already taken a decision that the law laid down by the Hon'ble Supreme Court in State of Karnataka and Others Vs. Uma Devi and Others is not applicable to the regularization of the services of the petitioners. She, therefore, submits that the words “as well as the law laid down by the Hon'ble Supreme Court in Uma Devi (Supra)” occurring in the operative part of paragraph No.7 of the order dated 03.08.2026 may be expunged/modified.
4. I have considered the submissions advanced by learned counsel for the petitioners and perused the record.
5. Having regard to the submissions made and the facts of the case, the prayer made in the present MCC deserves to be allowed.
