IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (Appellate Side) W.P.A. NO 20496 OF 2026 Tinku Shaw & Ors. -vs- The State of West Bengal & Ors. Mr. Sabyasachi Chatterjee, Mr. Satya Prakash Shaw, Mr. Imtiaz Akhtar ….for the petitioners. Mr. Abhijit Ray, Ms. Madhurima Basu, Mr. Surajit Singh ….for the State.
1. Affidavit-of-service filed on behalf of petitioners is taken on record.
2. There was a marital acrimony between petitioner no.2 and his wife, namely, Punam Shaw. Said Punam Shaw has not been made party in this writ petition.
3. Learned advocate representing petitioners alleges police inaction after complaint was lodged on 20th July, 2026 against said Punam Shaw. Prayer is made by presenting this writ petition thereby directing concerned police authorities to initiate proceeding against respondent nos.3 & 4 who are police officers.
4. Learned advocate representing State respondents has opposed this writ petition and disputes submission made on behalf of petitioner and it is specifically submitted that there is no overt action so far police authorities are concerned.
5. A communication dated 27th August, 2026 of Inspector- in-Charge, Belur Police Station, Howrah Police Commissionerate is place before this Court and same is taken on record.
6. It is disclosed in said communication dated 27th August, 2026 that after complaint was lodged on 20th July, 2026 effort was made by concerned police authorities for resolving dispute between petitioner no.2 and his wife and in continuation thereto petitioner no.2 and his wife were called to police station.
7. It is also disclosed in communication that wife of petitioner no.2 refused to lodge FIR against her in-laws and subsequently on intervention of concerned police authorities petitioner no.2 and his wife are leading their conjugal life.
8. It appears from submissions made on behalf of respective parties and taking note of contents of communication dated 27th August, 2026 that police officials took steps for resolving dispute between petitioner no.2 and his wife and Court finds that issues between petitioner no.2 and his wife are resolved.
9. Hence, no further order need be passed on this writ petition and same stands disposed of.
