In considering the prayer of the writ petition, it appears to be infructuous as on date. 2. Therefore, let this writ petition be disposed of as infructuous without prejudice to the contention of the petitioner as regards vires of section 164(2)(a) of the Companies Act, 2013, which the petitioner has challenged in the instant writ petition to be ultra vires. In Re: I.A. No. CAN 1 of 2025 3. I.A. CAN 1 of 2025, is an application for appropriate order filed by the present petitioner seeking refund of the amount mentioned, which he deposited with the learned Registrar General of this Court in terms of this Court’s order dated 31.10.2017. The same is also disposed of along with the writ petition. 4. Hence, it is directed that the amount of money to the tune of Rs. 10,00,000/-(Rupees Ten Lakh) along with accrued interest, if any, be immediately returned to the petitioner by the Registrar General, positively within a period of 2 four weeks from the date of communication of copy of this order. 5. With the aforesaid, the writ petition and the application (I.A. No. CAN 1 of 2025) are disposed of. 6. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Rai Chattopadhyay, J.)
