Saha …for the petitioners In Re: CO 37 of 2025 The learned advocate appearing for the petitioners may be justified in arguing that the learned Trial Judge without considering as to whether the proposed amendments are necessary for the purpose of deciding the real controversy between the parties, rejected the application for amendment. The petitioners are directed to serve a copy of this civil revisional application upon the opposite parties by registered speed post with acknowledgement due and file an affidavit of service on the next date of hearing. There shall be an order of stay of all further proceedings in Title Suit No 25 of 2013 pending before the learned Civil Jude (Junior Division), 1st Court at Purba Bardhaman till the end of the month of December, 2026 or until further order whichever is earlier. List this matter under the heading “Motion” in the Monthly List of September, 2026. In Re: CO 2501 of 2026 This application under Article 227 of the Constitution of India is at the instance of the plaintiffs and is 2 directed against an order being No. 102 dated July 18, 2026 passed by the learned Civil Judge (Junior Division), 1st Court, Purba Bardhaman in Title Suit No. 25 of 2013. By the impugned order, the prayer for adjournment at the instance of the petitioners on the ground of pendency of the civil revisional application being CO 37 of 2025, stood rejected and a date was fixed for argument. Today (21st August, 2026), this Court passed an order in CO 37 of 2025 granting an order of stay of all further proceedings in Title Suit No. 25 of 2013. Thus, nothing remains to be deiced in this civil revisional application. Accordingly, this civil revisional application stands disposed of.
