Mr. Subit Majumdar Mr. Guddu Singh ……for the State 1. Let affidavit-of-service, as filed in Court, be kept on record. 2. The petitioner is aggrieved that after the death of his father, who was serving as a Constable in the office of the Deputy Commissioner of Police, South Suburban Division (Jadavpur), Kolkata, under the Government of West Bengal, he should have been given the compassionate appointment. He is 41 years of age and has four other siblings along with his mother. 3. Upon death of an employee, it is the wife upon whom the right devolves, if at all, of compassionate appointment. 4. Irrespective of the applications made by any of the children of the deceased employee, it is the wife of 2 such employee, mother of the private respondents and the petitioner herein, who has the highest right. 5. If any of the children have made an application, the same has to be considered only if a requisite no- objection certificate is furnished from the mother in favour of such person. If the petitioner wants to apply, he is at liberty to do so along with a requisite no-objection certificate from the mother. 6. Mr. Singh, learned Advocate appearing for the authorities, informs that one of the sons has already filed an application for compassionate appointment with the requisite no-objection certificate from the mother on December 3, 2024. 7. In the light of the aforestated, this writ petition cannot be entertained and is accordingly dismissed. 8. There will be no order as to costs. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Reetobroto Kumar Mitra, J.)
