24.08.2026 Sl. No.3 Ct. No.14 ss IN THE HIGH COURT AT CALCUTTA Special Civil Jurisdiction APPELLATE SIDE WPCRC 78 of 2026 arising out of W.P.A. No.13259 of 2025 Sk. Md. Rafikul Islam Versus Syeda Mumtaz Begum, Pradhan of Kheput Dakshinbar No.7 Gram Panchayat Mr. Sandip Ghosh Mr. Patha Sarkar … for the Applicant/Petitioner. Ms. Priyanka Sharma Ms. Taneya Banerjee Mr. Taher Ahamed …for the Alleged Contemnor. 1. Affidavit of compliance filed on behalf of the alleged contemnor dated 24th August, 2026 is taken on record. 2. Perused the earlier affidavits of compliance dated 13th May, 2026 and 3rd August, 2026. 3. By order dated 10th August, 2026 the alleged contemnor was directed to file affidavit of compliance since the resolution adopted by the concerned Panahcyat on 8th June, 2026 did not decide the issue. 4. The compliance report filed by the alleged contemnor shows that the alleged construction is actually undertaken for repairing of the existing old structure/building and not a new construction. The inspection report made by the Nirman Sahayak 2 dated 5th January, 2026 annexed to the affidavit of compliance dated 13th May, 2026 also shows that the alleged construction is only renovation and repairing work done in a structure which is 50 years old. 5. In view of the above compliance, the contempt application being WPCRC 78 of 2026 stands disposed of. 6. Rule is, accordingly, discharged. 7. Personal appearance of the alleged contemnor is dispensed with. (Bivas Pattanayak, J.)
