In view of the urgency on behalf of the petitioner and by consent of the parties, the matter is taken up for hearing. This is a suit seeking specific performance of a Memorandum of Understanding. It is submitted on behalf of the petitioners that they are seeking expeditious disposal of the interlocutory application filed under Order 39, Rule 1 and 2 of the Code of Civil Procedure, 1908 in the suit. On behalf of the respondent, it is submitted that there has been a delay by the petitioner in filing their pleadings before the Trial Court. In view of the submissions made on behalf of the parties, C.O. 4474 of 2025 is disposed of by directing the Trial Court to expeditiously dispose of
2 the application under Order 39, Rule 1 and 2 of the Code of Civil Procedure, 1908 without granting unnecessary adjournments to any of the parties. It is made clear that there has been no adjudication of the merits of the case and all issues are left open for the Trial Court to decide in accordance with law.
